Q - My husband and I separated about three months ago. I took him to court to get custody of the children and to get support for the children and myself. He has been sending me letters and e-mails, threatening that if I keep asking the court for these things, “something bad will happen”. I tried to ignore them, but the last couple of letters have gotten worse. I’m getting more and more scared. He’s also been making threatening phone calls to my brother in the middle of the night. Can the court make a restraining order to stop my husband from bothering me and my brother?

A - You can certainly apply to the courts for a restraining order, as this sort of conduct is likely to be seen as falling within the meaning of the Family Law Act, and the person bothering you is your husband. However the restraining order made under the Family Law Act cannot protect your brother; he will have to seek a restraining order under a different law; he should seek a lawyer of his own.
